Business Visas are visas that address the needs of businesses. Although business visas are granted to benefit a company, it is usually granted to an individual. To obtain a business based visa, supporting documentation will be needed to support the visa application. This could be as minor as a supporting letter or a wage slip or it could be much more detailed (e.g. corporate papers, an office).

Individual visas are visas that address the needs of individuals. Like business based visas, supporting documentation will be needed to support the application. With the exception of the fiancée visa and marital visa, applicant will need to demonstrate strong ties to the UK. These are ties that will compel the applicant to return to the UK. Failure to provide the appropriate supporting evidence will result in a failed application.

UK Immigration

Miles Pierce advises companies, educational institutions, and individuals on UK Immigration. Miles Pierce advise companies on Tier 2 Licences, Tier 2 Skilled Workers and Preventing Illegal Employment. Miles Pierce also advises companies on Sole Representative Visas. Miles Pierce also advise educational institutions on retaining their accreditation and Tier 4 Student Visas. Miles Pierce advise and assists individuals on Tier 1 Visas. This includes Tier 1 General, Post-Study Work, Investors and Entrepreneurs. Miles Pierce also advises individuals on family based visas and citizenship visas. This includes Further Leave to Remain, Indefinite Leave to Remain.

In 2008, the Point Based System (“PBS”) came into effect. Under the Point Based System all employment and student based visa applications must obtain a minimum level of points. The number of points needed will be determined by the type of the visa application.

Under the Point Based System, all visa applications must meet the Maintenance Requirement and knowledge of the English Language Requirement. The amount needed to meet the maintenance requirement will be determined by the location of the application at the time the application is made. The only visa that does not require knowledge of the English Language is the Tier 1 Investor Visa. This is where a non-EU national will invest at least £1 Million into the UK. Also, the Tier 1 Investor Visa does not have to meet the maintenance requirement.

Tier 2 replaces the old Work Permit Scheme. For an employer to sponsor a non-EU national, it must have a Tier 2 Licence. To obtain the Tier 2 Licence, the employer must demonstrate that it is a real company. Furthermore, the Tier 2 Licence applicant must demonstrate that it has a HR System to prevent and detect illegal employment. Also, the employer must demonstrate that it will fulfil its duties and obligations as a Tier 2 Licence holder if it is granted the Tier 2 Licence.

One of the most common ways foreign businesses expand into the UK is through the Sole Representative Visa. The sole representative visa enables a non-UK business to come into the UK to set up an office or place of business in the UK.

  • One of the most important (at times one of the most complicated) issues to resolve in a divorce is the relationship the child or children of the marriage will have the parents. Ancillary relief is one of the three main issues in the divorce. Ancillary relief resolves the financial issues of the divorce. Ancillary relief issues are governed by Section 25 of the Matrimonial Causes Act of 1973.

Wills and Probate

Although there are many reasons to make your last will and testament, the most important are: 1) general family reasons; 2) appointment of legal guardians of children; 3) to take advantage of tax savings; and 4) to prevent problems for the people you left behind.

Lasting Power of Attorney was created by the Mental Capacity Act 2005 (MCA 2005). This Act covers England and Wales and allows you to make decisions whilst you have capacity and want to make preparations for a time when you may lack capacity in the future. Everyone working with and caring for adults who lack capacity, including family and friends must comply with the MCA 2005.

The term probate means a legal document issued to one or more people (called the executors) by the Probate Registry authorising them to deal with the administration of the estate.
The Probate Registry grants probate. This is known as the grant of representation, but can only do so after seeing legal proof that you are the executor. Once the Probate Registry confirms the executor, the executor can begin the administration of the estate.
